Privacy Policy

1. Purpose

1.1 Inventif Studio respects your privacy and takes the protection of personal information very seriously. The purpose of this policy is to describe the procurement, storage, usage, and protection of information that can be associated with a specific natural or juristic person and can be used to identify that person (hereinafter referred to as “personal information”).

Personal information includes:
1.1.1 Certain information collected on registration (see clause 4.1); and

1.1.2 optional information that you voluntarily provide to Inventif Studio (see clause 4.3).

1.2 Personal information excludes:
1.2.1 information that has been made anonymous so that it does not identify a specific person;

1.2.2 permanently de-identified information that does not relate or cannot be traced back to you specifically;

1.2.3 non-personal statistical information collected and compiled by Inventif Studio and information that you have provided voluntarily in an open, public environment or forum including (without limitation) any blog, chat room, community, classifieds, or discussion board. Since the information has been disclosed in a public forum, it is no longer confidential and does not constitute personal information subject to protection under this policy.

2. Business’s Declaration

2.1 Inventif Studio confirms that Inventif Studio has familiarised themselves with the content of POPIA, applicable regulations and/or policies and other rules relating to the protection of personal information and will strive to always adhere to these requirements and principles.

2.2 This policy must be read together with Inventif Studio’s Protection of Personal Information Policy and be compliant with it at all times.

2.3 Where there are discrepancies between this Policy and the Protection of Personal Information Policy the conditions of the latter will take preference.

3. Scope

3.1 This policy applies to all visitors to Inventif Studio’s websites and/or Inventif Studio’s online page.

4. Procurement of Information

4.1 On registration;

4.1.1 Once you register on our website and/or online page, you will no longer be anonymous to Inventif Studio as you will provide Inventif Studio with personal information. This personal information might include, but is not limited to:

4.1.1.1 Name, surname, company name, company registration number, VAT number
4.1.1.2 Postal address, email address, telephone number, postal code
4.1.1.3 Unique user ID, password

4.2 During use;
4.2.1 To provide the Services to you, you might be asked to provide Inventif Studio with additional information on a voluntary basis.

4.3 Optional Information;
4.3.1 You may also provide additional information on a voluntary basis (“optional information”). This includes content or product that you decide to upload or download from Inventif Studio’s website and/or online page or when you enter competitions, take advantage of promotions, respond to surveys, register, and subscribe for certain additional services, or otherwise use the optional features and functionality of the website and/or online page.

4.4 From Browser;
4.4.1 Inventif Studio automatically receives and records Internet usage information on Inventif Studio’s hosting company’s server logs from
your browser, such as your internet protocol address (“IP Address”), browsing habits, click patterns, version of software installed, system type, screen resolutions, colour capabilities, plug-ins, language settings, cookie preferences, search engine keywords, JavaScript enablement, the content and pages that you access on the website and/or online page, and the dates and times that you visit the website and/or online page, paths taken, and time spent on sites and pages within the website and/or online page (“usage information”).

4.4.2 Take note of the fact that other websites visited before entering Inventif Studio’s website and/or online page might place personal information within your URL during a visit to it, and Inventif Studio has no control over such websites. Accordingly, a subsequent website that collects URL information may log some personal information.

4.5 Web Beacons
4.5.1 Our website and/or online page may contain electronic image requests (called a “single-pixel gif” or “web beacon” request) that allow Inventif Studio to count page views and to access cookies.

4.5.2 Any electronic image viewed as part of a web page (including an ad banner) can act as a web beacon. Our web beacons do not collect, gather, monitor, or share any of your personal information. Inventif Studio merely uses them to compile anonymous information about our website and/or online page.

5. Purpose of Procurement

5.1 Inventif Studio may use any service information and optional information provided by you for such purposes as indicated to you at the time you agree to provide such optional information.

5.2 Inventif Studio may use your usage information for the purposes described in clause 4 above and to:
5.2.1 remember your information so that you will not have to re-enter it during your visit or the next time you access the website and/or online page;

5.2.2 monitor website and/or online page usage metrics such as total number of visitors and pages accessed; and

5.2.3 track your entries, submissions, and status in any promotions or other activities in connection with your usage of the website and/or online page.

5.3 Inventif Studio may use any service information and optional information provided by you send administrative messages and email updates to you regarding the website and/or online page. In some cases, Inventif Studio may also send you primarily promotional messages. You can choose to opt-out of promotional messages.

6. Consent to Collection

6.1 Inventif Studio will obtain your consent to collect personal information:
6.1.1 In accordance with applicable law; and

6.1.2 At the time you provide Inventif Studio with any registration information and optional information.

7. Disclosure of Information

7.1 Sharing;
7.1.1 Inventif Studio may share your personal information with an affiliate, in which case Inventif Studio will seek to require the affiliates to honour this privacy policy and any other relevant policies.

7.1.2 Inventif Studio’s service providers, under contract, who help with parts of Inventif Studio’s business operations (fraud prevention, bill collection, marketing, technology services).

7.1.3 The contracts referred to in clause 7.1.2 dictates that these service providers only use your information in connection with the services they perform for Inventif Studio and not for their own benefit;

7.1.4 Credit bureaus to report account information, as permitted by law;

7.1.5 Banking partners as required by credit card association rules for inclusion on their list of terminated merchants (if you utilise the Services to receive payments and you meet their criteria).

7.2 Regulators;
7.2.1 If you contact Inventif Studio regarding your experience with using any of our products, Inventif Studio may disclose your personal information as required of by law or governmental audit.

7.3 Statutory Reasons;
7.3.1 Inventif Studio may disclose personal information if required

7.3.1.1 By a subpoena or court order;

7.3.1.2 to comply with any law;

7.3.1.3 to protect the safety of any individual or the general public;

7.3.1.4 to prevent violation of our terms of service.

7.4 Marketing Purposes;
7.4.1 Inventif Studio may disclose aggregate statistics (information about the customer population in general terms) about the personal information to advertisers or business partners.

7.5 Employees;
7.5.1 Inventif Studio may need to disclose personal information to our employees that require the personal information to perform their duties.

7.6 Transfer of information outside of South Africa;
7.6.1 Inventif Studio may transmit or transfer personal information outside South Africa to a foreign country, as Personal information may be stored on servers located outside South Africa in a foreign country whose laws protecting personal information may not be as strict as the laws in South Africa.

7.6.2 You consent to Inventif Studio processing your personal information in a foreign country whose laws regarding processing of personal information may be less stringent.

8. No Selling of Information

8.1 Inventif Studio will not sell personal information.

8.2 No personal information will be disclosed to anyone except as provided for in this privacy policy.

9. Transfer of Ownership

9.1 If Inventif Studio undergoes a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, Inventif Studio may assign our rights to the personal information Inventif Studio process to a successor, purchaser, or separate entity.

9.2 Inventif Studio will disclose the transfer on the website and/or online page.

9.3 If you are concerned about your personal information migrating to a new owner, you may request Inventif Studio to delete your personal information.

10. Safeguards of Personal Information

10.1 Inventif Studio protects your personal information using computer safeguards such as firewalls and data encryption to protect personal information, and Inventif Studio authorises access to personal information only for those employees who require it to fulfil their job responsibilities.

11. Retention of Personal Information

11.1 Inventif Studio will try to keep the personal information Inventif Studio collects as accurate, complete, and up to date as is necessary for the purposes mentioned in clause 5.

11.2 From time to time Inventif Studio will request you to update your personal information on the website and/or online page.

11.3 You can review or update any personal information that Inventif Studio hold on you by accessing your account online or by emailing Inventif Studio or phoning us.

11.4 To better protect you and safeguard your personal information, Inventif Studio do take steps to verify your identity before granting you access to your account or making any corrections to your personal information.

11.5 Inventif Studio will only retain your personal information for as long as it is necessary to fulfill the purposes mentioned in clause 5, unless:
11.5.1 retention of the record is required or authorised by law; or

11.5.2 you have consented to the retention of the record.

11.6 During the period of retention, Inventif Studio will continue to abide our non-disclosure obligations and will not share or sell your personal information.

12. Limitations

12.1 Inventif Studio is not responsible for, give no warranties, nor make any representations in respect of the privacy policies or practices of any third-party website and/or online page.

13. Alterations

13.1 Inventif Studio may change the terms of this policy at any time.

13.2 Inventif Studio will notify you of any changes by placing a notice in a prominent place on the website and/or online page or by email.

13.3 If you do not agree with the change, you must stop using the services.

13.4 If you continue to use the services following notification of a change to the terms, the changed terms will apply to you, and you will be deemed to have accepted such terms.

14. Acceptance Clause

14.1 You must accept all the terms of this policy when you register for any of our services.

14.2 If you do not agree with anything in this policy, then you may not register for and use any of the services.

14.3 You may not access our website and/or online page or use our services if you are younger than 18 years old or do not have legal capacity to conclude legally binding contracts.

14.4 By accepting this policy, you are deemed to have read, understood, accepted, and agreed to be bound by all its terms.
